Terms of Service

These terms govern use of the current Kona Business AI website and web application.

1. ELIGIBILITY AND ACCOUNTS

  • You must be able to form a legally binding agreement in your jurisdiction and use the Service for a lawful purpose.
  • If you use Kona for an organization, you represent that you are authorized to act for that organization.
  • You must provide accurate account information and protect access to your Google account and Kona session.
  • You are responsible for activity performed through your account unless you promptly report unauthorized access.

2. CURRENT ACCESS AND FUTURE PAID FEATURES

As of the date above, Kona is offered on a Free plan and does not require a paid subscription or credit card. Kona does not charge usage overages under the current Free plan. If Kona later offers a paid feature, the purchase flow must disclose the price, billing period, renewal behavior, included usage, cancellation process, and any additional terms before you authorize a charge. These Terms do not create a paid subscription by themselves.

3. LICENSE AND PRODUCT CHANGES

Subject to these Terms, Kona grants you a limited, non-exclusive, non-transferable, revocable right to access and use the Service for lawful personal or internal business purposes. Features may change, be limited, or be removed. The Product Capabilities page distinguishes verified, limited, and planned capabilities; a planned capability is not part of the Service until it is actually released.

4. ACCEPTABLE USE

You may not:

  • use the Service to violate law, another person's rights, or a contractual duty;
  • submit malware, exploit code, unlawfully obtained data, or content you do not have permission to process;
  • attempt to bypass authentication, authorization, rate limits, safety controls, approval gates, or service boundaries;
  • interfere with the Service, probe it without authorization, or access another user's account or workspace;
  • misrepresent AI-generated work as verified fact or professional advice where doing so could harm another person;
  • resell or provide unauthorized access to the Service; or
  • use automated access in a way that materially burdens the Service or conflicts with published technical controls.

5. USER CONTENT AND PERMISSIONS

You retain whatever rights you have in prompts, files, connected data, workspace records, and other content you submit ("User Content"). You give Kona a limited permission to host, copy, transmit, transform, and display User Content only as needed to provide, secure, troubleshoot, and support the Service, comply with law, and enforce these Terms. You represent that you have the rights and permissions needed to submit User Content and to instruct Kona and its providers to process it.

Kona's application does not contain a pipeline that trains a Kona model on User Content. Upstream model providers process inputs under their applicable configuration and terms. See the Privacy Policy for current data-handling details.

6. AI OUTPUT AND HUMAN REVIEW

Text, calculations, research summaries, sources, images, files, code, and other generated material ("AI Output") may be inaccurate, incomplete, outdated, non-unique, or unsuitable for your purpose. Source links, evidence ledgers, scenarios, and review flags help inspection but do not guarantee correctness. You are responsible for reviewing AI Output, validating material claims and calculations, obtaining professional advice when appropriate, and deciding whether and how to use the output. Kona is not a law, accounting, investment, medical, or other professional-advice service.

7. OUTPUT RIGHTS

To the extent Kona has rights in AI Output generated specifically for you, Kona does not claim ownership of that output against you. Your ability to own or exclusively use AI Output may be limited by applicable law, third-party rights, the non-unique nature of model output, and upstream provider terms. You are responsible for any external publication or commercial use.

8. CONNECTORS AND EXTERNAL ACTIONS

A connector is governed by both these Terms and the connected provider's terms. You are responsible for granting only appropriate permissions and for disconnecting access you no longer need. Kona currently supports defined read-only provider paths and does not represent connector write operations as available. Approval and governance interfaces are control foundations; they do not authorize Kona to modify an external provider until the applicable capability is explicitly released and you approve the action.

9. THIRD-PARTY SERVICES

Kona relies on third parties for hosting, authentication, storage, model processing, analytics, and optional connected services. Their products and terms are outside Kona's control. We are not responsible for third-party services, but we will describe material Kona-side dependencies and boundaries as reasonably practical.

10. AVAILABILITY, SUPPORT, AND BETA RISK

The Service is provided on an evolving, as-available basis. Unless Kona signs a separate written agreement that says otherwise, there is no contractual uptime SLA, response-time commitment, service credit, guaranteed job completion, or promise that a provider or feature will remain available. The public System Status page is a high-level service indicator and is not an independently audited SLA report.

11. SUSPENSION AND TERMINATION

You may stop using the Service at any time. Kona may limit or suspend access when reasonably necessary to protect the Service or another user, respond to law, investigate abuse, or address a material breach of these Terms. Where practical, Kona will provide notice and an opportunity to correct the issue. Data handling after termination is described in the Privacy Policy; complete self-service account-wide deletion is not currently represented as available.

12. DISCLAIMERS

TO THE EXTENT PERMITTED BY LAW, THE SERVICE AND AI OUTPUT ARE PROVIDED "AS IS" AND "AS AVAILABLE." KONA DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. NOTHING IN THESE TERMS EXCLUDES A WARRANTY OR CONSUMER RIGHT THAT CANNOT LAWFULLY BE EXCLUDED.

13. LIMITATION OF LIABILITY

TO THE EXTENT PERMITTED BY LAW, KONA WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY ARISING FROM THE SERVICE. KONA'S TOTAL LIABILITY FOR CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID KONA FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. THIS LIMIT DOES NOT APPLY WHERE APPLICABLE LAW DOES NOT ALLOW IT.

14. INDEMNITY FOR MISUSE

To the extent permitted by law, if you use the Service for an organization, you will defend and indemnify Kona against third-party claims arising from your unlawful use, your User Content, or your material breach of these Terms. This section does not apply to individual consumers where prohibited by law.

15. CHANGES TO THESE TERMS

Kona may update these Terms as the Service changes. The date at the top identifies the latest version. Material changes will be presented through a reasonable product or website notice before they apply when required. If you do not agree to an updated version, stop using the Service.

If a provision is unenforceable, the remaining provisions remain effective. Failure to enforce a provision is not a waiver. You may not transfer these Terms without Kona's consent; Kona may transfer them as part of a merger, reorganization, financing, or sale of the Service.
